150 mila secondo la polizia, 1 milione per gli organizzatori. in tanti sono scesi ieri sul lungo senna per protestare contro la legge che riconosce le nozze omosessuali. In Italia, da qualche tempo, si propone l’introduzione di una legge che sanzioni la omofobia. stando alle cronache giornalistiche, per la presidente della camera laura boldrini l’aggravante potrebbe essere suscettibile di applicazione anche a chi avversa le unioni omosessuali. la manifestazione francese dimostra, però, come è solo a costo di una indebita semplificazione che le posizioni contro le nozze gay possono essere ritenute espressione di omofobia. è evidente che tra i manifestanti ci saranno state persone e gruppi che coltivano atteggiamenti discriminatori, ma non si può certo aprioristicamente ritenere tali tutti i 150 mila che sono scesi per strada. anche perché – e spesso si fa finta di dimenticarlo – le posizioni contrarie alle nozze gay hanno solide radici culturali: la legge naturale (la stessa legge naturale sulla base della quale si professa l’eguaglianza tra gli uomini). non intendo qui discutere circa la legittimità delle unioni tra omosessuali ma piuttosto evidenziare come il codice penale non possa essere lo strumento per affrontare un tema tanto impegnativo che coinvolge non solo i diritti e le libertà individuali (la coppia) ma anche l’interesse generale (la prole) per le implicazioni che ne derivano circa le adozioni e la fecondazione artificiale.
